Note: The Teaching Faculty at the Tax Law Institute is proficient in orthodoxShari'ahLaw, specifically to Islamic banking and financial instruments. We assist in assessing the tax consequences for the financing of working capital under the Murabha, 'Ina, Salam and Istisma' contract as well as the financing of receivables, long-term or under leasing clauses (Ijara). We address financial practice under non-binding (Ja'iz) versus binding (Lazim), risk of loss (daman) versus trust (Amana), rules governing delay in payment and in performance -- the sale of dayn for dayn -- and the tax implications of 'The Promise' (Wa'd) in Islamic law. Under special contractual arrangements, we help in determining the tax effects related to cost of debt under the various Islamic contracts permitted under the Shari'ah.
